We advise and represent companies and works councils in matters of collective employment law. In particular, we can provide representation in negotiations about severance plans and achieving a balance of interests, as well as before arbitration boards.
In the area of individual employment law, we advise employers and employees on all employment relationship questions, from drafting contracts of employment through giving notice to the wording of references, and we have successfully represented employers and employees in court.
We provide advice to companies, boards and executives on drafting service contracts, as well as representing companies and their executive bodies in court when disputes arise about rights under the service relationship or about its termination.
BUILDING AND ARCHITECTURAL LAW
We represent property developers, large, medium and small building companies, as well as tradesmen, architects and private developers in all areas of private and public building law. Our services for our clients range from out-of-court advice and representation through to protecting their interests in judicial disputes.
We advise our clients on inheritance law questions and the drafting or interpretation of wills, as well as on inheritance disputes after the death of a relation. We endeavour to achieve amicable settlements for the sake of family relationships. However, where positions are entrenched, litigation may offer a solution to the problem.
We advise our clients in all areas of family law, especially with help writing pre-nuptial and consequences of divorce agreements. Our aim in this is always to try to find the right solution, tailored to the specific professional and private situation. We also represent our clients in the event of a divorce and subsequent matters, as well as in all other cases before the family court.
TRADE AND COMPANY LAW
We advise entrepreneurs, partners and executives, and when companies are being formed or acquired we can help to choose the appropriate articles of association. We represent partners to help them exercise their partners’ rights, and we advise boards, executives and partners with regard to their rights and duties under the articles of association as well as under company and insolvency law. We offer judicial and extrajudicial representation when disputes arise between partners.
We represent property developers, private developers, vendors, buyers, agents and management companies in all questions of property law. For example, we help with the drafting or interpretation of partition deeds, or reviewing and adapting property purchase deeds, as well as with questions of estate agent law. Our support ranges from purely providing advice, through out-of-court altercations to litigation.
INSOLVENCY AND CONTESTATION LAW
We advise partners and executives of companies at risk of insolvency with regard to their personal risks in connection with the threat facing their business, and we work out strategies to avoid these risks coming to pass.
If you are a creditor and unable to enforce your claim because of a debtor’s lack of funds, and there is reason to suspect that the debtor has illegally transferred assets, then we are happy to represent you in proceedings with the aim of ensuring that the claim is enforced against the transferred assets.
We not only take care of classic debt collection as a one-off or a few times a year, but also handle bulk collection management for major corporations. At the same time, we always ensure that each case receives the necessary attention, with each case being treated as if it were a single case and helped to reach the best possible result.
TENANCY AND APARTMENT PROPERTY LAW
We represent landlords and tenants in private and commercial tenancy law matters. Likewise we represent homeowners’ associations and management companies in issues of apartment property law. One key area of our work is commercial tenancy law.
Where possible we settle contentious issues out-of-court to maintain the relationship between the contracting parties. However if this is no longer possible, especially after termination of contract, we are not afraid to take legal action.
We represent care facilities and services nationwide on all aspects of billing and remuneration, and provide comprehensive support during official inspections by the care home supervisory body and the health funds. We have years of experience in debt collection for care home fees. At the same time we also advise individuals to claim the appropriate care benefits and grades, and where necessary, we will also take our client’s interests to court.
We represent our clients in all areas of criminal law, especially commercial criminal law, both in relation to the investigating authorities (police and public prosecutor) and in court proceedings. Our work also covers representation during criminal prosecution and imprisonment, as well as asserting the claims and interests of victims of crime.
We represent our clients in both civil and criminal traffic law matters. Our work here ranges from representation in criminal and summary proceedings for traffic violations and accidents, through representation in administrative proceedings, for example for withdrawal of the driver’s licence, to enforcement or defence of claims for compensation resulting from accidents.
We give our clients comprehensive advice on all insurance issues, e.g. disability insurance, accident insurance and private health and sick pay insurance. Besides examining claims for benefits against insurers, registering and asserting claims for insurance benefits, contesting unjustified rejection, withdrawal and other refusal to perform, we also offer advice and representation in cases of mis-selling by insurance brokers.
We represent companies and private individuals in administrative proceedings and appeals as well as in disputes before the administrative courts. Key areas include representation of developers and neighbours in disputes about the scope and content of building permits as well as regarding access to schools.
